At BAR FEVER (WESTON-SUPER-MARE) LTD we are committed to protecting & respecting your privacy.  This Privacy notice outlines how and why we use your personal data, to make sure you stay informed and can be confident about giving us your information.

How do we collect your personal data?

We collect your data when you make a booth enquiry, apply to be on the guestlists via text, fill in enquiry forms on our websites, when you sign up to WiFi in one of our Venues, in job applications, via CCTV and by our staff in person using written or electronic collection methods in the venue. We will only collect the data that we need to identify and communicate with you.

The personal data that you give us could be name, title, date of birth, gender, email address, mobile phone number, user names & passwords, dates and locations of visits and CCTV Images.

How we use your personal data

General Communications

We may need to contact you about your visit in compliance of a valid request from the Police, licensing or governmental authorities following a visit to our premises.

Marketing

We may send you marketing communications via text, email, or post under the basis of Legitimate Interest or in the course of a Sale or Negotiation of a Contract as you will have either been a customer or have enquired about visiting or purchasing goods or services from us. These communications will contain an opt-out option that you will be able to access to choose not to receive further communications

We may also ask for your specific consent to send you marketing communications (opt-in) at the time we collect your data. If you do no opt-in we will not process your data for Marketing purposes.

We do not use any of your information for any advertising targeting. We do not collect data through third parties not directly appointed by us for that purpose or share any information with 3rd parties for marketing purposes.

Profiling

We may use your data to help us understand our customers with regards to times and days of attendance and other aspects of our service.

We may use age and gender profiling & targeting to provide relevant communications to our customers for specific nights.

Recruitment & Employment

In order to comply with our contractual, statutory, and management obligations and responsibilities, we process personal data, including ‘sensitive’ personal data, from job applicants and employees.  

Such data can include, but isn’t limited to, information relating to health, racial or ethnic origin, and criminal convictions. In certain circumstances, we may process personal data or sensitive personal data, without explicit consent. Further information on what data is collected and why it’s processed is given below.

Contractual responsibilities: Our contractual responsibilities include those arising from the contract of employment. The data processed to meet contractual responsibilities includes, but is not limited to, data relating to: payroll, bank account, postal address, sick pay; leave, maternity pay, pension and emergency contacts.

Statutory responsibilities: Our statutory responsibilities are those imposed through law on the organisation as an employer. The data processed to meet statutory responsibilities includes, but is not limited to, data relating to: tax, national insurance, statutory sick pay, statutory maternity pay, family leave, work permits, equal opportunities monitoring.

Management responsibilities: Our management responsibilities are those necessary for the organisational functioning of the organisation. The data processed to meet management responsibilities includes, but is not limited to, data relating to: recruitment and employment, training and development, absence, disciplinary matters, e-mail address and telephone number.

Disclosure of data to other bodies

Where Police, Licensing or other Governmental require access we may supply personal details and information about visits and activities in order to comply with Legal Obligations, Vital or Public interests. In order to carry out our contractual and management responsibilities, we may, from time to time, need to share an employee’s personal data third party suppliers. These suppliers will be expected to contractually agree to handle data in an appropriately secure and compliant fashion.

To meet employment contracts or statutory responsibilities, we may be required to transfer an employee’s personal data to third parties, i.e. pension providers and HM Revenue & Customs.

Your data protection rights

Where BAR FEVER (WESTON-SUPER-MARE) LTD is using your personal data on the basis of consent, you have the right to withdraw that consent at any time. You will be asked to provide the following details:

- The personal information you want to access
- Where it is likely to be held
- The date range of the information you wish to access

We will also need you to provide information that will help us confirm your identity. If we hold personal information about you, we will give you a copy of the information in an understandable format together with an explanation of why we hold and use it.

Once we have all the information necessary to respond to your request we will provide your information to you within one month.

In the first instance, please talk to us directly so we can resolve any problem or query. You also have the right to contact the Information Commissioners Office (ICO) if you have any questions about Data Protection. You can contact them using their help line 0303 123 113 or at www.ico.org.uk.

Keeping your information

We will only use and store your information for as long as it is required for the purposes it was collected for. How long it will be stored for depends on the information in question, what it is being used for and, sometimes, statutory legal requirements. 

How we secure your data 

Data security is of utmost importance to us. Your data will be held on state of the art secure servers in our UK based data centres. Access will only be granted to authorised employees or agents of the company. 

We frequently audit users with access to customer data and remove any access in accordance with out minimum-privilege-requirement policy. Staff are trained in data security and aware of the laws and regulations regarding the holding, processing and access of data.

All transactional data and web form processes will be handled via encrypted pages using the industry minimum 2048 bit encryption.

Disclosing and sharing information

In order to carry out Marketing, customer research, data security and storage or other key tasks we may use third party suppliers, contractors or agents to act on our behalf and allow them controlled access to personal data where necessary.

We maintain clear contractual obligations that our suppliers comply with all relevant UK law and maintain acceptable data protection policies and data security. We control how much data they see, how long it is accessed for and what may be done with it. We do not sell or share your data for use by any other organisation.

Storage of information

Our data is primarily stored within the UK and European Union (EU). Some organisations which provide services that host or manage data for us may transfer data outside the EU in order to carry out their service. We will only permit this where adequate protection of our data can be shown and policies such as the US Privacy Shield or recognised equivalents are followed by our suppliers.

CCTV

Please note that we may operate Closed Circuit Television (CCTV) and you may be recorded when you visit our premises. These images are classified as personal data.

CCTV systems are installed (both internally and externally) in premises for the purpose of enhancing security of the building and its associated equipment as well as creating a mindfulness among the occupants, at any one time that a surveillance security system is in operation. Footage is stored for set period of time after which it is recorded over.  We comply with the Information Commissioner’s Office CCTV Code of Practice and we put up notices so you know when CCTV is used.

We’ll amend this privacy policy from time to time to ensure it remains up to date and reflects how and why we use your personal data and new legal requirements. Please visit our website to keep up to date with any changes. The current version will always be posted on our website.
